﻿{"id":1047,"date":"2019-02-08T12:25:28","date_gmt":"2019-02-08T15:25:28","guid":{"rendered":"http:\/\/ifbaiano.edu.br\/portal\/servidor\/?page_id=1047"},"modified":"2019-02-08T12:25:46","modified_gmt":"2019-02-08T15:25:46","slug":"reconducao","status":"publish","type":"page","link":"https:\/\/ifbaiano.edu.br\/portal\/servidor\/reconducao\/","title":{"rendered":"Recondu\u00e7\u00e3o"},"content":{"rendered":"<p class=\"western\" align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: 'Open Sans', sans-serif\"><span style=\"font-size: small\"><strong>Conceito<\/strong><\/p>\n<p>Recondu\u00e7\u00e3o \u00e9 o retorno, \u00e0 atividade, do servidor est\u00e1vel ao cargo anteriormente ocupado, em decorr\u00eancia de n\u00e3o aprova\u00e7\u00e3o em est\u00e1gio probat\u00f3rio em outro cargo, desist\u00eancia do cargo a que estava submetido a est\u00e1gio probat\u00f3rio ou reintegra\u00e7\u00e3o do ocupante anterior do cargo.<\/p>\n<p><strong>\u00a0Requisitos e procedimentos<\/strong><\/span><\/span><\/span><\/p>\n<p class=\"western\" align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: 'Open Sans', sans-serif\"><span style=\"font-size: small\">1. Estabilidade no cargo federal anterior.<\/span><\/span><\/span><\/p>\n<p class=\"western\" align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: 'Open Sans', sans-serif\"><span style=\"font-size: small\">2. Inabilita\u00e7\u00e3o em est\u00e1gio probat\u00f3rio, reintegra\u00e7\u00e3o do ocupante anterior do cargo ou desist\u00eancia de cargo p\u00fablico durante o per\u00edodo de est\u00e1gio probat\u00f3rio.<\/span><\/span><\/span><\/p>\n<p class=\"western\" align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: 'Open Sans', sans-serif\"><span style=\"font-size: small\"><span style=\"text-decoration: underline\">O processo dever\u00e1 ser instru\u00eddo com os seguintes documentos:<\/span><\/span><\/span><\/span><\/p>\n<p class=\"western\" align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: 'Open Sans', sans-serif\"><span style=\"font-size: small\">1. Reprova\u00e7\u00e3o no est\u00e1gio probat\u00f3rio; ou<\/span><\/span><\/span><\/p>\n<p class=\"western\" align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: 'Open Sans', sans-serif\"><span style=\"font-size: small\">2. Desist\u00eancia durante o est\u00e1gio probat\u00f3rio; ou<\/span><\/span><\/span><\/p>\n<p class=\"western\" align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: 'Open Sans', sans-serif\"><span style=\"font-size: small\">3. Ato de reintegra\u00e7\u00e3o do ocupante anterior do cargo.<\/span><\/span><\/span><\/p>\n<p class=\"western\" align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: 'Open Sans', sans-serif\"><span style=\"font-size: small\"><br \/>\n<strong>Condi\u00e7\u00f5es para\u00a0efetiva\u00e7\u00e3o da Recondu\u00e7\u00e3o: <\/strong><\/span><\/span><\/span><span style=\"color: #000000\"><span style=\"font-family: 'Open Sans', sans-serif\"><span style=\"font-size: small\"><\/p>\n<p><strong>1.<\/strong> Ocorrer\u00e1 \u00e0 recondu\u00e7\u00e3o na hip\u00f3tese do servidor que n\u00e3o for aprovado no est\u00e1gio probat\u00f3rio ter ocupado, antes de assumir o novo cargo, outro cargo no servi\u00e7o p\u00fablico federal. Nesse cargo anterior, o servidor j\u00e1 deveria estar est\u00e1vel e ter se desligado atrav\u00e9s do instituto da vac\u00e2ncia.<br \/>\n<\/span><\/span><\/span><\/p>\n<p class=\"western\" align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: 'Open Sans', sans-serif\"><span style=\"font-size: small\"><strong>2.<\/strong> \u00a0O servidor tem o prazo de 120 (cento e vinte) dias para solicitar a recondu\u00e7\u00e3o, a contar da publica\u00e7\u00e3o na imprensa oficial do ato que declarou a inabilita\u00e7\u00e3o do interessado no est\u00e1gio probat\u00f3rio ou do ato de vac\u00e2ncia, no caso de desist\u00eancia, sendo direito do servidor declinar de tal prazo.<br \/>\n<\/span><\/span><\/span><\/p>\n<p class=\"western\" align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: 'Open Sans', sans-serif\"><span style=\"font-size: small\"><strong>3.<\/strong> Ap\u00f3s a reprova\u00e7\u00e3o no est\u00e1gio probat\u00f3rio caber\u00e1 ao \u00f3rg\u00e3o onde o servidor foi reprovado comunicar ao \u00f3rg\u00e3o onde o servidor j\u00e1 era est\u00e1vel essa reprova\u00e7\u00e3o. O \u00f3rg\u00e3o anterior providenciar\u00e1 a elabora\u00e7\u00e3o da Portaria de Recondu\u00e7\u00e3o que dever\u00e1 ser publicada no Di\u00e1rio Oficial da Uni\u00e3o.<\/span><\/span><\/span><\/p>\n<p class=\"western\" align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: 'Open Sans', sans-serif\"><span style=\"font-size: small\"><strong>4.<\/strong> Ap\u00f3s a publica\u00e7\u00e3o da Portaria de Recondu\u00e7\u00e3o, dever\u00e1 ser providenciada, imediatamente, pelo \u00f3rg\u00e3o que reprovou o servidor no est\u00e1gio probat\u00f3rio, a respectiva exonera\u00e7\u00e3o do cargo mediante publica\u00e7\u00e3o da Portaria de exonera\u00e7\u00e3o no Di\u00e1rio Oficial da Uni\u00e3o.<\/span><\/span><\/span><\/p>\n<p class=\"western\" align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: 'Open Sans', sans-serif\"><span style=\"font-size: small\"><strong>5.<\/strong> No caso de cargo de origem j\u00e1 se encontrar provido, o servidor ser\u00e1 aproveitado em outro cargo de atribui\u00e7\u00f5es e vencimentos compat\u00edveis com o anteriormente ocupado.<\/p>\n<p><strong>6.<\/strong> A recondu\u00e7\u00e3o n\u00e3o d\u00e1 direito \u00e0 indeniza\u00e7\u00e3o.<\/span><\/span><\/span><\/p>\n<p class=\"western\" align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: 'Open Sans', sans-serif\"><span style=\"font-size: small\"><strong>7.<\/strong> No caso de desist\u00eancia, \u00e9 necess\u00e1rio requerimento do servidor junto ao \u00f3rg\u00e3o em que j\u00e1 era est\u00e1vel durante o est\u00e1gio probat\u00f3rio.<\/span><\/span><\/span><\/p>\n<p class=\"western\" align=\"JUSTIFY\">\n<p class=\"western\" align=\"JUSTIFY\"><strong><span style=\"color: #000000\">Base legal<\/span><\/strong><\/p>\n<p align=\"JUSTIFY\">Art. 41, \u00a72\u00ba da Constitui\u00e7\u00e3o Federal de 1988.<\/p>\n<p>Artigo 20, \u00a7 2\u00ba; artigo 28, \u00a7 2\u00ba; artigos 29 e 30 da Lei n\u00ba 8.112, de <span id=\"OBJ_PREFIX_DWT168_com_zimbra_date\" class=\"Object\"><span id=\"OBJ_PREFIX_DWT177_com_zimbra_date\" class=\"Object\">11\/12\/90<\/span><\/span> (DOU <span id=\"OBJ_PREFIX_DWT169_com_zimbra_date\" class=\"Object\"><span id=\"OBJ_PREFIX_DWT178_com_zimbra_date\" class=\"Object\">12\/12\/90<\/span><\/span>).<\/p>\n<p align=\"JUSTIFY\">Parecer AGU n\u00ba JT-03, de <span id=\"OBJ_PREFIX_DWT170_com_zimbra_date\" class=\"Object\"><span id=\"OBJ_PREFIX_DWT179_com_zimbra_date\" class=\"Object\">27 de maio<\/span><\/span> de 2009.\u00a0<a href=\"http:\/\/ifbaiano.edu.br\/portal\/servidor\/wp-content\/uploads\/sites\/5\/2016\/08\/PARECER-JT-03.pdf\" rel=\"\">PARECER JT &#8211; 03<\/a><\/p>\n<p>S\u00famula Administrativa AGU n\u00ba 16, de <span id=\"OBJ_PREFIX_DWT171_com_zimbra_date\" class=\"Object\"><span id=\"OBJ_PREFIX_DWT180_com_zimbra_date\" class=\"Object\">19 de junho<\/span><\/span> de 2002.<\/p>\n<p>Nota Informativa CGNOR\/DENOP\/SRH\/MP n\u00ba 37 de <span id=\"OBJ_PREFIX_DWT172_com_zimbra_date\" class=\"Object\"><span id=\"OBJ_PREFIX_DWT181_com_zimbra_date\" class=\"Object\">25\/01\/2012<\/span><\/span>.\u00a0<a href=\"http:\/\/ifbaiano.edu.br\/portal\/servidor\/wp-content\/uploads\/sites\/5\/2016\/08\/NOTA-INFORMATIVA-37-2012-Recondu\u00e7\u00e3o.pdf\" rel=\"\">NOTA INFORMATIVA 37 &#8211; 2012 Recondu\u00e7\u00e3o de servidor<\/a><\/p>\n<p>Nota DECOR_CGU_AGU n\u00ba 117-2009-JGAS, de <span id=\"OBJ_PREFIX_DWT173_com_zimbra_date\" class=\"Object\"><span id=\"OBJ_PREFIX_DWT182_com_zimbra_date\" class=\"Object\">26 de junho<\/span><\/span> de 2009.\u00a0<a href=\"http:\/\/ifbaiano.edu.br\/portal\/servidor\/wp-content\/uploads\/sites\/5\/2016\/08\/NOTA-DECOR_CGU_AGU-N\u00ba-117-2009-JGAS.pdf\" rel=\"\">NOTA DECOR_CGU_AGU N\u00ba 117-2009-JGAS<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Conceito Recondu\u00e7\u00e3o \u00e9 o retorno, \u00e0 atividade, do servidor est\u00e1vel ao cargo anteriormente ocupado, em decorr\u00eancia de n\u00e3o aprova\u00e7\u00e3o em est\u00e1gio probat\u00f3rio em outro cargo, desist\u00eancia do cargo a que estava submetido a est\u00e1gio probat\u00f3rio ou reintegra\u00e7\u00e3o do ocupante anterior do cargo. \u00a0Requisitos e procedimentos 1.
